Superior Court Judge B. Theodore Bozonelis has ordered that the certificate of election issued to Republican Jerry Stevenson be invalidated and a new certificate of election be issued to Democrat Dan Dunham so that he can be sworn into office at the January 1st reorganization meeting of the Madison Borough Council.
The victory was achieved by having all properly cast votes counted. Dan is now ahead of Jerry by 3 votes following the re-opened recount.
Mr. Stevenson could further contest this result, but that seems unlikely at this writing.

There seems to be a faint odor around this vote-counting issue. Why were provisional ballots not counted until a recount petition was filed? Why did the (Republican) county clerk not issue supplemental voter rolls (new voters) prior to the election? Read Geoffrey Thomas's letter to the editor in The Independent Press for more on this. While you are at it, go to the online version of that paper to read a fascinating comment by a reader who thinks that Drew University students should not be able to vote in town elections. Vox populi?!
